In the action of the Nelson College Governors (at the instance of the combined insurance companies) v. Savage and Sons, a claim for .£9970 for alleged negligent use of a pressure burner in violation of" a contract, leading to the destruction of the Boys' College, the Judge said that the issue was as to whether such a burner caused the fire. Tlie jury, by an eleventwelfths majority, answered in the negative, and returned a- verdict for defendants. Notico of appeal was given and a fortnight was taken for a decision on the question.
