CLAIMS BELSEN TRIAL UNJUSTIFIED Recd. 6 p.m. London, Nov. 7. “Nobody who comes before the British Court is convictable unless the prosecution has proved beyond all doubt that he is guilty under the law of time committal,” said Colonel T. A. Smith, a London professor of international law, speaking for the defence at the Belsen (.rial at Luneberg. “If I can persuade tne Court to agree on this fundamental principle, I verily believe the decision would go down in history as one of the judgments which, against al] lhe popular clamour, is decided strictly in accordance with the law.” Colonel Smith argued that the trial should never have been held as no war crime had been committed.
