Damages amounting to £lOOO were awarded in the Arbitration Court by Mr. Justice Frazer in favour of Mary Evans, whose husband, David Evans, barman at the Masonic Hotel, Napier, was killed during the earthquake on February 3, 1931. Deceased ran out into the street and was killed on the pavement, and it was held that the ambit of scope of duty was impliedly extended under the Act to cover the danger area in respect of a building and its curtilage.
