SEQUEL TO COLLISION
WIDOW’S CLAIM UPHELD.
[Per Pre«B Association.] WELLINGTON, Nov. 14,
Judgment was entered to-day for plaintiff in the case in which the jury awarded Mrs Rose May Blake £lO5O against Lawson John August as the result of the death of her husband, following a collision at Petonc. It was stated that the jury had made the award under a misapprehension that the insurance company would only pay up to £lOOO. His Honour (Mr Justice Recd) said that he was surprised that the jury, having found for plaintiff, had not awarded greater damages. He laughed at counsel’s remark that the additional £5O had been awarded as punishment. He said that no doubt it was a compromise verdict. Costs were fixed according to scale, and his Honour certified for an extra day of trial at £l5 15s w’ith witnesses’ expenses, disbursements, and interrogatory proceedings.
