JUDGE ALLOWS APPEAL AGAINST DECISION GIVEN BY MAGISTRATE.
Per Press Association. PALMERSTON N., February 20. A reserved judgment by Mr Justice Ostler was delivered in the Supreme Court in an appeal by the Woodville Borough Council against a decision of Mr Free, S.M., in dismissing informations in regard to alleged breaches of the building by-laws. The appeal was allowed and the matter was referred to the Magistrate to fix the penalties. The case was one in which the defendant was charged with erecting a party wall otherwise than in accordance with the by-laws and also failing to pull down the wall within a reasonable time after" due notice had been given. The Magistrate decided that th>S law was settled in a previous decision of the Supreme Court in which it was held that a certificate of an inspector was conclusive that the building was in accordance with the by-law.
