A CLAIM FOR DAMAGES.
A suit in which Miss Ellen Evea sued 1 the Omaka Road Board for £1000 damages ' was heard by the Chief Justice and a 1 special jury, at Blenheim, last Monday. The circumstances of the case were that as the plaintiff and another young lady 1 were- being driven from Waihopai into 1 Blenheim on the night of July 31 last the horse shied at some heaps of timber which had been left on the roadside for repairing work, upsetting the vehicle and throwing the occupants out on the road. The trap was damaged, and . the plaintiff claimed to have sustained injuries from which she would sufier for the remainder of her lite. The: defendant Board denied the charge . of negligence,' and asserted that the' accident was the result of careless driving. The jury found for the plaintiff, but assessed the amount of damages at £12, and costß were allowed on the Magistrate's Court scale. Misß Gibbie also claimed £1000 for injuries received in the same accident, and was awarded £35, with costs j as in the other case.
