MOTORIST FINED.
INTOXICATED IN CHARGE. FOUND SITTING IN CAR. FUTILE- EXPLANATION, [By Telegraph.—Press Association] TE AROHA, Feb. 18. A charge of being intoxicated in charge of a motor-car was preferred against Clarence James Davis, who appeared before- Mr. F. H. Levien, S.M., in the Police Court yesterday. Evidence was given that accused was Bitting in his car in an intoxicated condition, and when warned by a constable ho at first left the car, but later returned to ti. He was discovered there by the constable and taken in charge. There was u partly-con-sumed keg of beer in the car. • Mr. F. Burns, for accused, admitted that Davis, was intoxicated, but denied that he was in charge of the car. He had no intention of driving the car and did not have the ignition key in his possession. Accused was sitting in the car because he was feeling unwell and did not wish to go into the house where he was boarding. The magistrate held that when tho owner of a car sat in the driving scat he was apparently in charge of tho vehicle, and added that a drunken man in a car was potentially a source of danger.
Accused waa fined £5 and costs.
