'PLANE PLYING FOE HIRE. DEFINED AS .CARRIAGE. INFORMATION DISMISSED. (By Telegraph—Press Association.) VVANGANUI, July 15 Mr J. H. Salmon, S.M., delivered judgment in the case, Police v. Captain Brake, the latter having been charged with plying for hire with an aeroplane at Castlecliff Beach on Sunday, June 21. The magistrate held tha.t the aeroplane is commonly used for the conveyance of passengers, mails and baggage, being propelled by mechanical power. If the object of the Statute (sub-sdetion 3 of section 18) was to exempt from the operation of sub-section 1 all means of (transport of passengers, whether for pleasure or necessity, then he would not be doing violence to the sub-section if he extended the meaning of the word "carriage" to include an aeroplane used for the carriage of passengers, mails and luggge. The information against Captain Brake was accordingly dismissed.
