THE DEAN CASE AGAIN.

Wellington, Saturday.
A motion for leave to appeal in the case of Eegina v. Minnie Dean was argued in the Appeal Court to-day-All the five judges were present. Dr. Findlay appears in support of the motion, and Messrs McDonald) Crown Prosecutor at Invercargill, and Gully, Crown Prosecutor, Wellington, for the Crown. Dr. Findlay, in opening the case, said he was unable to support the first ground of the notice of motion. He could not contend that the evidence as to the infant Hornby had been improperly admitted. He wouJd contend, however, that evidence as to the other infants and the finding of the skeleton at the Larches had been improperly admitted. The argument ia proceeding. Later. In the Dean case the Court decided | to hear the Crown in reply at 10.30 on Monday morning. This day. When the Appeal Court resumed, the Bench said it was unnecessary to call on Mr McDonald to reply. The Judges were unanimous that there was no case to answer, and they would give their reasons in writing on Wednesday.
