MEAT COMPANY’S DIFFICULTIES. By TelezraDh —.press Association. NEW PLYMOUTH, Dec. 15. Mr Justice Alpers' decision in the case, Dunn, Morgan and 111. others v. the Taranaki Fanners’ Meat Co., was given in the Supreme ■ Court this morning. _. .. Plaintiffs claimed recission of a contract to take shares on the ground of misrepresentation of material facts, and non-disclosure of a of an expert’s report. The ground of fraudulent concealment of.ian alleged agreement between director, guarantors and the Bank of New Zealand, was abandoned during the trial. The hearing occupied seven days at the end of September. ' The judgment covers 23 typcd-fools-cap sheets. The Judge finds that the charge of alleged misrepresentation is not sustained, also that the proper time for taking action, if any, was in September, 1924, when authority was given to sell the works. Judgment would be for defendants in all cases except that of Joseph Dunn, whose application, for shares - was made in April, 1924, by which time representations which were justifiable in the latter half of 1923 ceased to be so. Costs were allowed defendants as on a claim for .£3710. The Judge stated the charge of fraud should novel- have been brought.
