WELLINGTON, April 29. _ The appeal in the case, of the ; Public Trustee v. the Commissioner of Stamps was dismissed with costs on the highest scale ay from a distance. this is .the case in "yfliiclv& ..betjti&st w&s left for builclipg the Anglican Cathedral in' Dnnedin, on ■which 1 a tax of £3582 was claimed and appealed against. The Appeal Court saad the Courts in New Zealand/held tliat the word " charitable" in. the Act w:is not used in its-technical sense. ;It was ■employed; in English Acts, and did not apply to gifts to religious sects or denomination's. The present- bequcet was not a gift in the popular sense,, and not: such a gift .as ,b exempted from taxation. It is'understood that leave will be aslced-to appeal to the Privy Council.
