IMPORTANT APPEAL CASE.

(By Telegraph.) New Plymouth, Nov. 1. In the Supremo Court in banco to-day nn appeal was made by Mr Samuel, the Solicitor for the Official Assignee, against a judgment of the District Court, by w'lich it was ruled that Mr Win. Bay ley was not an e3topdelent by a previous judgment from Bending in a proof of debt in Humphries and Son's estate, in respect of the trusteeship for the wife by a member of the firm. After a lengthy argument, His Honor said ho had not the slightest doubt that the appeal must be allowed with costs. Mr Hutchison, who appeared for the trustee, Mr Bayley, asked to be allowed to appeal further. His Honor said it was perfectly clear that at the time the promissory note was given by Humphries to his wife the estate wa3 utterly insolvent. There must be an end to litigation, and ho therefore refused tho appeal.
