FURTHER PROCEEDINGS.

In the Magistrate's Court this afternoon, before Mr H. S. Fitzherbert, S.M., Mr Quilliam, on behalf of the Crown, applied for a re-hearing of the case of the Police y. George Bishop, a charge of permitting drunkenness on the licensed premises known .'. as the Taranaki Hotel. The application was made on the ground that further evidence had been obtained that could not be adduced ' at the time the case was heard. His Worship said that he could not grant such an application unless he had before him affidavits of the witness or witnesses showing what fresh evidence had been obtained, in order that he could judge whether it would be. likely to affect his previous decision and whether ordinary diligence had been used in obtaining evidence at vthe original hearing. Mr. Quilliam then stated that he would call Sergeant Haddrell to give evidence to show that due diligence had been used in collecting evidence. He would then ask his Worship to adjourn the application to enable him to obtain an affidavit from the fresh witness.

Haddrell then deposed that at the time of the trial he had no knowledge cf the whereabouts of Mary O'Donnell, who had been employed as a barmaid at the Taranaki, Hotel on the date of the alleged offence. Knowledge of her whereabouts had come to him casually. As the defence had made much of the fact that the barmaid could not bj found and that she could have given evidence in favour of the defence, ho realised that she was an important witness. A,sign%d statement had been obtained fiom this woman, He had no opportunity at the time of the trial of knowing where the woman was or what knowledge she had of the affair. Mr Quilliam then formally applied for an adjournment. Mr Grey further objected at length to the proceedings. He laid great stress on the way in which the matter was dragging on and had dragged on before the trial. His Worship granted Mr Quilliam's application for an adjournment, the affidavit to be laid before him on the 29th inst., at 10.80 a.m.
