NEGLIGENCE OF DRIVER.
COLLISION CASE RECALLED.
An echo of a recent civil claim m the Supreme Court at New Plymouth was heard in the Hawera Magistrates Court yesterday, when Edward John Bigham was fined £2, with costs 12s, for negligent driving on the Normanby Road near Manaia on June 8. Mr. W. H. Woodward, S.M., was on the bench. An unusual feature of the case was that Bigham’s brother was successful in his Supreme Court claim for damages against Dr. A. M. Young, with whose car he collided. Damages were assessed at £630, but yesterday Sergeant J. Henry, who prosecuted, said that there was no evidence of negligence on the part of Dr. Young. There was evidence, however, that Bigham had been definitely negligent in his driving. Mr. R. J. O'Dea said the . accident had occurred before , the amendment to the right hand rule was operative. He asked for a light penalty.
