LOSS OF PACING GELDING
CASE COMMENCED AT AUCKLAND.
SUIT BY SILVER BINGEN’S OWNER.

An action arising out of the loss of the pacing gelding Silver Bingen, which it was alleged had to be destroyed after it had been gored by a dangerous bull belonging to the defendant, was heard in the Magistrate’s Court when the owner of the horse, Mrs. I. E. Sweetapple, claimed £152 damages, including £2 2s veterinary surgeon’s fee, from Hugh Hedley, farmer, Auckland. In the’statement of claim Mrs. Sweetapple said Silver Bingen had been delivered to Hedley on April 13 and in return for caring for the horse he was to receive 5s a week. It was alleged that owing to Hedley’s negligence the horse was attacked by a bull in the same paddock, with the result that the horse had to be destroyed on May 22. The defence was that there had been no contract between Mrs. Sweetapple and Hedley and that Hedley was not guilty of negligence. The case was adjourned until to-mor-row.
