NAYLOR’S DISQUALIFICATION
MOVE TO CONTINUE INJUNCTION. THE LEGAL ARGUMENT BEGAN. By Telegraph—Press Assn.—Copyright. Rec. 10.10 p.m. Sydney, April 12. Argument began to-day on Rufus Naylor’s application for a continuation of the injunction against the Australian Jockey Club. An affidavit prepared by Rowe, secretary of the A.J.C., was read. It disclosed that Naylor was disqualified on the ground that he gave false or misleading evidence in connection with the ownership of a horse named Movado, which was allegedly not allowed to do its best at the Gosford country meeting on February, 1933, and consequently was disqualified. During the subsequent inquiry Naylor was informed that the stewards were of the opinion that a man named Punch, owner of Gesto, was also “dummying” for Naylor. Counsel for Naylor argued. that the club by-law unde.'? which Naylor was disqualified was invalid and that the A.J.C. acted without legal authority. The case was adjourned. Arising out of the disqualification of Rufus Naylor, who was associated with Winooka’s trip to America, Naylor applied for an interim injunction to restrain the Australian Jockey Club committee from further proceeding upon its decision, said a cable received on March 31. The court granted the application and Naylor is now issuing a writ claiming £lO,OOO damages against the Australian Jockey Club for alleged libel. The committee disqualified Naylor during. its pleasure under Rule 171. Naylor was formerly prominent as a bookmaker. The committee also disqualified F. J. Punch under another part of the same rule until he attends to answer certain questions. The horses Movado and Gesto are also disqualified during the committee’s pleasure.
