JUDGMENT REVERSED
DEFINITION OF CAR SERVICE.
DECISION OF CHIEF JUSTICE.

Napier, Aug. 22.
The reserved judgment of the Chief Justice in the case in which Nash, own-er-driver of a service car plying between Napier and Hastings, appealed against a conviction by the Magistrate for breach of a by-law, reverses the decision and allows costs. His Honour stated that appellant’s vehicle did not come within the definition of a borough omnibus, as the termini were not both within the borough. The vehicles were, therefore, motor cabs, under which licenses they have been operating. They were, however, liable to taxation in both boroughs.
