JUDGE DISMISSES AN APPEAL. By Telegraph.—Press Association. Dunedin, December 18. Mr. Justice Kennedy gave his decision in the Supreme Court to-day in a case in which the police appealed against the finding of tlie magistrate in dismissing an information charging Philip Barling with selling liquor without a license. The facts were that the Scottish Society held a reception to the Mayor, Mr. Mcßae, in the premises known as the Savoy, owned by Barling, the charge for admission being ss. Barling undertook to permit the reception to be held in the lounge, which was not a .restaurant, and provide- supper, which did not include alcoholic liquor. McKenzie, a supporter of the society, provided liquor at his own cost. Persons admitted to the reception were guests of the society, and not of Barling. The Magistrate held that there was an absolute gift of the liquor to the Scottish Society, and in this the Judge agreed. The appeal was dismissed.
