A CONVICTION QUASHED.

Auckland, August. 16. Before Mr Justice Dennistori an anpeal was made by Samuel Wood, a : milkman, against the decision of the Magistrate in convicting him on a charge of mixing extraneous ingredients with milk, to wit, boric acid. After evidence was given his Honor said there wrs no doubt the offence had been committed, but the question was as to whether it was the appellant who did it. Before a man could be guilty of the offence of "mixing", he must "mix", and it was for the Crown to prove it. but no proof whatever had been given. The appeal was allowed. His Honor said that if the effect of his decision was to render the section useless, then perhaps the Legislature might legislate further on the matter.
