LANDLORD AND TENANT
NOTICE TO QUIT INVALID. A reserved decision of Mr F. H. Levien, S.M., dealing with the validity of a notice to quit, was given in the Magistrate’s Codrt at Otorohanga on Friday. In the action Mrs L. A. Palmer (Mr Phillips) sought to recover from Nurse A. B. Percy possession of certain premises in Otorohanga occupied by defendant as a monthly tenant. For the defendant, Mr Trapski contended that the notice to quit was invalid inasmuch as the plaintiff was not possessed of the legal estate on account of her transfer not having been registered when notice was given. This contention was supported by the magistrate, who non-suited the plaintiff, with costs.
