CYCLIST CLAIMS DAMAGES ACTION AT HAMILTON Press Association HAMILTON, Today. A claim for £1,500 damages for injuries allegedly received as a result of a collision between a motor-cycle and a motor-lorry near Te Kuiti on November 2 last, was brought by the rider of tho cycle, Francis Oliver Hewetson, cycle dealer, of Te K.uiti, against H. Tetzaff. carrier of Kinohaku. before Mr. Justice Herdman and a jury in the Supreme Court at HamThe statement of claim states that plaintiff was riding his motor-cycle when .efendant, driving a lorry, crashed into him, throwing him to the ground and causing a large wound on bis head and a fracturing of lus right knee-cap. Permanent injury had been caused to his right leg and he suffered considerably from shock. He was unable to continue his daily employment as a cycle dealer, and his business had lost his services from November 2. 1928. to the present date. Plaintiff alleged the collision had occurred owing to defendant tailing to keep to his proper side and through his failing to keep the machine in proper control by driving at a dangerous speed and in a dangerous manner. . . . The defence was a general denial or negligence and lack of skill, and, alternatively, that plaintiff was guilty of contributing negligence. (Proceeding.)
