GARAGE PROPRIETOR AWARDED DAMAGES
COLLISION BETWEEN CARS (United Press Association) HAMILTON, December 8. A verdict for the full amount claimed, £2508 4/7, against both defendants was returned by the jury in favour of plaintiff in a case finished before Mr Justice Callan in the Supreme Court in which Charles Sciver Goodwill, a garage proprietor, of Te Puke, sought damages from Kathleen Saulbrey, of Ngaruawahia, and Edwin James Parry, a farmer, as a result of an accident on the Main south road at Horotiu on January 27. Plaintiff was a passenger in a car being driven by Doris Mary Hudson from Te Puke to Auckland. Mrs Saulbrey was driving south and was about to turn into Duxfield road, Horotiu, when she was overtaken by the car driven by the other party. There was a collision between Parry’s and Mrs Saulbrey’s cars and a collision between Parry’s car and the car in which plaintiff was seated. Plaintiff received severe injuries. He alleged negligence on the part of both Mrs Saulbrey and Parry. For the defence, the allegations of negligence were denied and, as an alternative, contributory negligence on the part of the driver of the plaintiffs car was alleged. When the jury returned the verdict a new trial was asked. Judgment was deferred pending the hearing of legal argument.
