RAI LAV AY DEPARTMENT APPEAL. DISMISSED BY PRIVY COUNCIL. (By Telegraplf.—Press Assn. —Copyright) LONDON. .Inly 26. The Judicial Committee of the Privy Council dismissed with costs the New Zealand appeal Rex versus Broad. (The claimant in this important case was Mrs Broad, who claimed from the New Zealand Railway Department 12000 under the Deaths by Accident Compensation Act for the death of her husband, who was killed at a level crossing when riding a motor bicycle. The case was heard in the Supreme Court at Wanganui, and the Department carried it in July last to the Court of Appeal in Wellington, when a majority of the Judges decided in favour of the claimant. One of many important points raised was whether the Railway Department had •shown negligence in the extent of metal on the crossing.)
