MAGISTERIAL.

TIMAEU—YESTERDAY. (Before B. Woollcombe and T. W. Hall Esqs.) CIVIL CASES. (The following was crowded out last night.) J. G. Tanner v. J. W. Carpenter, claim £7 17s Bd, for wages. Mr Raymond for plaintiff, Mr Hamersley for defendant. This was an action arising out of certain occurrences on board the barque Mary Ann Annison, whereof plaintiff was a seaman and defendant is master, having been appointed on the 19th inst. It appeared that on going on board the vessel on the 20th, defendant found a boat which had been made fast by a painter and a shackle and chain at the gangway had broken adrift, and defendant thereupon accused plaintiff of being the cause of the loss of the boat through his unseamanlike way of making her fast, whereupon plaintiff became very abusive and was ordered to quit the vessel, which bo did. The parties bad both signed articles on the 19th., and defendant was willing to pay plaintiff wages for a day and a half, but plaintiff demanded a month’s pay in lieu of notice, hence the present action. Yesterday afternoon the evidence of defendant, his chief officer, and the oook w as heard, to prove the allegations of defendant as to the misconduct of plaintiff, and the fact that the vessel was so moored (by a hawser over each quarter, spread broad asbear) as to allow of a boat being made fast to the stern.

The case was further adjourned, and as the vessel sailed this morning, the local agents will continue the defence on behalf of the Captain.
