EXECUTORS’ CASE PR ELTMI N ARY 11M ART NO An Application, preliminary to the hearing of an appeal against a judgment of the Supreme Court, for leave to bring further affidavits as evidence and make an addition to the statement of defence, was heard by the Court of Appeal in Wellington last week. Decision was reserved. In the Supreme Court at- Napier Thomas Charles Cornford, of Pahiatua, fanner, and Wyvern Benjamin Gillies, of Mastorton, fanner, executors of the estate oi Percy Alexander Gillies, successfully sued James Raymond Gower, of Otane, sheepfarmer, and Rupert Llewellyn Gower, of Wairoa, farmer, as executors of the estate of Benjamin Gower, late of Otane, .sheepfarmer, for principal and interest owing under second mortgage. Plaintiffs in the Supreme Court were awarded iu all £4OOI. which included costs.
