COMPANY SEEKS DAMAGES ROTORUA OASE An interesting ease arising out ol the Motor Transport Act was heard bcloro Mr. S. L. Baterson, S.M.. in the Rotorua Magistrate's Court. K -Motors, Limited, of Rotorua, sued Newby's Motors, Limned, of Hamilton, for £SO damages for running an allegedly illegal service lietween Hamilton and Rotorua on a service route. It was stated on behalf of K Motors, Limited, that the company had hoi'll granted a license by the trauspoit- authority to operate on this route and the respondent company load run motor services on the route for about two months without a license. Mr. Watts contended that the. ■respondent had not done. K Motors any harm, as it. was not running on the same time table as K Motors. Tiie magistrate said the legal point was wh'ther Iv Motors, Limited, had the right to sue for damages in view of the fact that penalties were already provided for in the Motor Transport Act.
Lengthy legal argument by counsel for both sides ensued. At the ((inclusion of the hearing the magistrate said that, owin'/ to the intricacies ol the points of law involved in the ease, he would reserve his decision.
