APPEAL DISMISSED
HUNTER WILL CASE APPELLANTS TO PAY COSTS (Per Press Association.) WELLINGTON, last night. The Court of Appeal this 'afternoon delivered judgment in the appeal of Cyril Paul .Hunter and Thomas Percy Hunter, trustees in the estate of the late Sir George Hunter, against the judgment of Mr, Justice Reed, delivered last April in the Hunter will case. The judgment of the court, prepared by the Chief Justice, Sir Michael Myers, and delivered by Mr. Justice Adams, wAs that the appeal should be dismissed with costs on the highest scale. In the course of the judgment His Honor said: “The onus of proof of testamentary capacity is upon the appellants, and wo are unable to conic to the conclusion that, in view of all the circumstances of the case, they‘have succeeded in proving testamentary capacity, even on the date’of the last codicil.,’ The eburt also held'that,- as the appeal was prosecuted mainly in the interests of the two appellants, costs must 'be paid by them personally., ,, ■.
