A SHEPHERD’S INJURIES CLAIM AGAINST FARMER FAILS Compensation from his employer, George Reynolds, sheepfarmer, of Gisborne, for the loss of his lelt eye in an accident that occurred while in Ins employ, was sought by Edward Herbert English, shepherd, of Wairoa, in the Arbitration Court at Napier im Saturday, before Mr. Justice Frazer, Mr. \V. Cecil Prime, employers' reprosen tall ive, and Mr. A. J.. Mouteith, employees’ representative. Mr. I>. A. Rogers appeared for the plaintiff and Mr. K. J. \\. llalletl for defendant. Air. Rogers stated that at the time of tho accident the plaintiff, was employed by the defendant as a shepherd on his Waireka properly. On or about October IC, 1928, plain till was thrown from his horse when riding round the property in the course of his employment, and as a result of the accident sustained severe injury to his left eye, ultimately causing llie loss of the sight of the eye. The average earnings of the plaintiff were 10s per week. Tho plaintiff claimed a lump sum reppresenting compensation due to Die plaintiff for tho loss of the sight of his left eye, the sum of £1 for medical attention necessitated by the accident, the costs of the action, and such further or other relief as might be just under the circumstances, Mr. Ilallett stated that the whole of the defence was to show that the loss of sight of the plaintiff's left eye was not (lue io the accident while in the employ of the defendant. Evidence would bo given to show that plaintiff had had difficulty in counting and drafting. Air. Ilallett stated that he wished to point out'the significance of the jfact that neither a doctor nor a sight specialist who had been consulted by the plaintiff had been called by the plaintiff.
