ILLEGAL BETTING.

SENTENCE OF THIRTY-TWO DAYS,

(Per Press Association.) AUCKLAND', this day

Judgment was given by Mr Poynion, S.M.. in the Police Court to-day in a case in which William G. _ Brown, a linesman, was charged om eight informations with betting with Consta-blo Brown. He was originally charged with carrying on tiie business of bookmaker. He objected to tho magistrate hearing the other charges, on the ground that ho intended to elect trial by jury before the Supreme Court on the charge of carrying on the business of bookmaker. He questioned the right of the prosecutor to substitute summary charges to defeat thd major charge going before the Supreme Court. The Chief Justice refused an application for a writ of prohibition. Accordingly, Mr Poynton delivered judgment. He held it was proved that tlie accused was a bookmaker who betted on: tote odds with a constable, and also that there was cvidenca of a. system. Brown was found guilty on one charge. The Magistrate said it was not a case for a fine. Tho accused was fined £3OO a- year ago, but it would appear tlie fine bad no deterrent effect. He inflicted a sentence of 32 days’ imprisonment. Security for appeal was fixed at £2O. The warrant was suspended and the other cases adjourned pending tlie bearing of the appeal.
