JUSTIFIABLE SHOOTING ARRESTED MAN’S DEATH SYDNEY, February 22. (Received Feb. 23, at 0.30 a.m.) A finding that Richard Augustus Thurling died from peritonitis following a bullet wound justifiably inflicted on him by Constable Kenneth Boyd while acting in the discharge of his duties was returned by the coroner following an inquiry into Thurling’s death. Evidence was given that Thurling, who was 28 years of age, was fatally wounded by a bullet fired by Boyd to frighten Thurling, who was allegedly endeavouring to escape after the police had stopped a lorry on which were crates of fowls.

The coroner said: “If an officer of the law endeavours to arrest a man who committed felony and the felon is flying from justice, and there is no other we.y to apprehend him, it is justifiable to use extreme measures. The evidence is quite clear that Thurling was arrested for stealing a large quantity of fowls.”
