APPEAL ACTION FAILS. fJPsa Unites Press AssocraTcow-V WESTPORT, Septemlwr 13. Tho Supremo (kiurt was occupied yesterday ia licaring the appeal of tlio WestporfcSfcockton Coal Company v. Watcrsou. Tho respondent was a brakesman in tho appellant company's colliery, and we 3 injured in a tunnel in September last. In July last ho claimed damages in tho Warden's Court for £300. Tho assessors awarded tho full amount ebimed and costs. Tlio defendant company appealed, in accordance with tho provisions- of tho Mining Act, by way of a rehearing. A jury of four waa empanelled on, tho application of tho respondent. Tho jury returned a verdict for tlio full amount. By agreement among counsel certain legal points wero deferred for agreement before tho Full Court at Wellington.
