CHARGE AGAINST THE COMPANY DISMISSED.

At the instance of tho, Grey Lynn Borough Council tho Auckland Tramway Company was to-day proceeded against for failing oa August 14 to tun tho 7.32 p.m. car from Grey Lynn in accordance with tiho oompa.ny's timo-tablc submitted to and approved by the council. Alter hearing the, evidence, Mr Kettle, S.M., said the wholo question wnsiiwliether the company had wilfully and deliberately neglected to ran this particular 'oar. Before ho could convict it would have to bo shown that tho conductor was, in refusing to start on this account, acting according -to tho companyls instructions; and • the prosecution had failed to show that. Tho information was therefore dismissed.
