THE LICENSING ACT.

(Peb United Pesss Association.)

Wellington, February 20.

At the Supreme Court to-day Jußtice Richmond heard an appeal case in which Albert White, licensee of the Universal Hotel, Eketahuna, who was convicted (1) of having sold liquor on Sunday, (2) having exposed liquor for sale on the same occasion, and was fined £1 and £5 respectively, appealed against the decioion. His Honor quashed both convictions on the first charge. He said he regretted to have to do so on the ground that liquor was supplied to a lodger, who had shouted for some friends. He could not hold with Mr Hutchison, S.M., that the liquor had also b«en supplied to the man's friends, who were not lodgers. Tha Legislature never intended that n lodger could call in Tom, Dick, and Harry from the street and treat them in prohibited hours, and he folt sure when this defect was pointed out in the law it would be altered. Hia Honor quashed the second charge because the liquor was exposed for the purpose of enabling a lodger to be served. It was shown in evidence that other persons than the man's friends had come in and the publican refused to supply them with liquor.
