Tho plaintiff and his mate, who were sworn by tho blowing onfc of a match, said that they had taken nine paits of fowls to tho defendant, who had agreed to purchase eight pairs, at 4s Cd per pair, ono couple of fowln being rejected as being " poor and thin." Tho bargain was made on a Saturday, and tho witnesses wero told to come for their money in the evening. They did not go until the following Monday, when they wero told that they must allow for ono pair. This they refused to do, and believing that they wero to cefc tho full amount, the plaintiff signed tho receipt, but on tho 31s Cd being tendered to them they declined to accept it, and it wm left on the counter. The defence was that ono p.iir of tho fowls were unfit for use. Tho Magistrate said that was no defence at all.
