SALE OF A BUSINESS
LAND AGENT’S CLAIM. Air J. S. Evans. S.M., was engaged yesterday in hearing a case in which Fred. Fanning, land agent (Mr J. (7Donovan), proceeded against C. F. Baudinet, tobacconist (Mr E. P. Hay), for the sum of £47 10s. The statement of claim set out that the amount was commission at 5 per cent., alleged to be due to the plaintiff on the sale of tile defendant’s tobacconist Business, No. 142, Lambton quay, Wellington, to A. A. Duncan on March 31st last For the defendant, it was contend* ed that the plaintiff had not been instrumental in bringing the parties together; that the parties had conducted direct negotiations: and that, al the most. Fanning had only accelerated the sale. The magistrate determined to reserve his decision.
