PAID TWICE
INTERESTING COURT DISPUTE. William Mansfield, monumental mason, proceeded against the Now Zealand Elxpress Company in the Magistrate’s Court yesterday to recover os Gd, a charge for cartage which, ho said, ho had paid twice. Plaintiff, who was represented Mr B. P. Bunny, said that he had paid the account but afterwards paid it again as he could not find Uifc -e ceipt. When he subsequently found the receipt and presented it to the Express Company they would not BP vo him a refund. The defendants, represented by Mr J. C. Morrison, said that the carrier who delivered the goods (some marble slabs) was given a stamped receipt, as it was anticipated''that payment would be made on delivery. - The carrier handed the receipt ovor without payment being made. However, the carrier coul-i not he called, as he had left the employ of the company, end his whereabouts were unknown. Mr P. L. Hollings. S.M., who heard the case, gave judgment for the- plaintiff. Ho said he could not understand a firm giving a receipt without getting paid, and he could not under stand a carrier handing over a stamped receipt for money he did not get. Plaintiff’s story was hacked np by two receipts. His Worship was not prepared to discredit plaintiff’s evv dene© and take the view that Mansfield committed deliberate 0U jury for the paltry sum involved.
