Upon hearing the Solicitors for the plaintiffs and defendant respectively and by consent, it is ordered that the defendant, his servants and agents, be and they are hereby perpetually restrained from infringing the plaintiffs’ registered Trade Mark No. 2318, consisting of the words, "Pearl Cream” by use of the words “Pearl Cream,” in respect of goods not of the plaintiffs’ manufacture or merchandise, and from cutting, engraving, casting, or making and from causing to be cut, engraved, cast, or made; and also from using or permitting to be used and from soiling or otherwise disposing of or parting with, any blocks of plates adapted, for printing labels or sheets of labels in imitation of the label of the plaintiffs used by them in the get-up of their goods sold under their said Trade Mark or differing only colourably therefrom and from printing or selling or exposing for sale or procuring to be printed or sold any labels similar to those in use by the plaintiffs* or any other papers or labels go printed or contrived as by colourable imitation or otherwise to represent or load to the belief that the preparation put up by other parties under the title of "Pearl Cream” was the preparation or merchandise of the plaintiffs put up under their said Trade Mark. And it is further ordered that the said defendant deliver up for destruction any of such blocks or plates as are'now in his possession, custody, or power to the plaintiffs or such person as they shall appoint to receive the same. And it is further ordered that the defendant pay to plaintiffs or their Solicitors, Messrs Waters and Crespin, the sum of .£5 damages for the said infringement and the sum of .£lO 10s costs.
