(PER PRESS ASSOCIATION.) Auckland, April 15. On the morning of the day the s.s. Arawata left Fiji an application was made by P. S. Solomon to the Supreme Court to set aside or vary an order staying proceedings in the appeal case W. Macarthur and Co. v. Cornwall and Manaema. Mr W. Cooper opposed the application, Mr Solomon urged that the order should either be discharged or the proceedings stayed only on terms. The Chief Justice dismissed the application, remarking that the appellants, W. Maoarthur and Co., were certainly entitled to have the proceedings stayed pending an appeal to the Privy Council, as it was quite possible it might be held on appeal that they were rightfully In possession.
