COMPENSATION AWARD

INJURED WATERSIDE WORKER Reserved judgment on an application by the New Zealand Shipping Company, Limited (Mr. J. B. Elliot), for the termination of worker's compensation payments to Robert McDougall (Mr. Sullivan), was delivered in the Compensation Court yesterday by Mr. Justice ()'Regan. His Honor said McDougall, a waterside worker, suffered injuries on March 2-i while working on a vessel in port. After discharge from hospital it was discovered that he was suffering from advanced heart disease. This was the first time McDougall was aware of this condition. The company contended that respondent: had recovered from the accident and was now disabled by heart disease. Respondent claimed that his condition was worsened bv the accident and that lie was entitled to compensation accordingly. After reviewing the medical evidence and authorities quoted. His Honor said he found the argument that the accident, had not aggravated the effects of the disease became quite untenable, and that respondent was entitled to substantial compensation. In entering judgment for respondent 11Honor allowed him a lump sum of £'Bls 10s 8(1, in addition to the £1.85 already paid at the rate of £1 10s for 80 weeks. Respondent was also allowed £l9 19s costs.
