CAPONE GUILTY.
VERDICT OF THE JURY. EVASION OF INCOME TAX. (Received October 18, 8.45 p.in.) NEW YORK, Oct. 17. Alphonso Caponc, Chicago's notorious gangster, was convicted by a jury in the Federal Court at Chicago this evening, after more than eight hours' deliberation, on five out of twenty-three counts which charged him with evading payment of income taxes. The maximum penalty is imprisonment for 17 years and a fine of £IO,OOO. Caponc smiled as the verdict was read. Tho trial ended in confusion, with the Government apparently more concerned over tho jury's failure to convict Capone on 17 of tho counts than the defence was with the conviction on five. Capone and his counsel, all smiling, went into the corridor. Mr. Michael Ahern, one of the accused's lawyers, said it was what he expected. Judge Wilkerson, after much discussion, granted the request of counsel for the defence to argue their motion for arrest of judgment, and set Tuesday as the time. The Judge adjourned the Court without passing sentence, and indicated that he would sentence Capone on Tuesday, after hearing motions from both sides.
