PROVISION FOR GRAZING. • WOMAN AWARDED DAMAGES. [by telegraph.—own correspondent.] TE AROIiA, Friday. 1 In the Magistrate's Court at Te Aroha r yesterday afternoon, before Mr. J. W. - Poynton, S.M., Florence Mary Smith - (Mr. MacGregor) sued Patrick Hogan 1 (Mr. Gilchrist) for £l6O as damages in 1 respect to certain cows which defendant i undertook to graze for plaintiff. Plaintiff stated that in June last she entered' into an arrangement with Hogan j whereby the latter agreed to graze 20 cows for plaintiff at 2s 6d a head per 3 week. It was contended that the cows, when plaintiff sent them to Hogan, were . in good condition and that when they reJ turned they had deteriorated. One of i the cows, a" pedigree Shorthorn, had died while on Hogan's property, and for this beast £2O was claimed. The balance of 3 £l4O was claimed for depreciation in the ' value of the other cows, which were pedi--1 gree and grade Friesians, through neglect J on the part of defendant to- provide suit- , able grazing. 3 The defence was an absolute denial of ' responsibility. It was maintained that the l cows, when they came on to defendant's paddock, were a poor conditioned line and ' that they were, in a paddock which was ' recognised as the best grazinz block in the district. Other people's cows on the . paddock at the same time came off in the best of condition. The magistrate held that there had been some neglect on the part of Hogan and awarded plaintiff £lO damages, with , costs £6 15s.
