LAND SALE DISPUTE.
CONTRACT SIGNED BY WIFE. CASE BEFORE APPEAL COURT. [BY TFJ.EGRAPH.—OWN CORRESPONDENT.] WELLINGTON, Thursday. An appeal from tho judgment of Mr. Justice Adams was heard by the Court of Appeal to-day. The appellant was Charles Richard Craythorne, farmer,- of Christchurch, and the respondents wero Malcolm Ernest Jenkins, executor of the will of Ernest Edmund Jenkins, and Marion Amy Jenkins, widow. The case arose out of a contract for sale of land in May, 1926, involving an amount of approximately £22,750. Tho question at issue was whether the contract, which was signed by Mrs. Jenkins, was her contract, or whether she signed as the a,-ent of her husband. Tho latter died subsequent to the date of tho signature of contract, leaving a large estate, and Mrs. Jenkins had no means, Mr. Justice Adams found that the contract was the wife's but this decision was appealed against, the appellants contending that tho contract was tho husband's. There was also a cross appeal by Mrs. Jenkins to the effect that there was no contract at all. The Court reserved decision.
