LORRY AND CAR COLLIDE.
COURT CASE AS SEQUEL.
CLAIM AND COUNTER-CLAIM.
A claim and counter-claim arising out of a collision between two motor vehicles were heard by Mr. E. C. Cutten, S.M.. in the Magistrate's Court yesterday. Plaintiff, Thomas Matthew Finlayson (Mr. Jnder), sought to recover £57 17s lOd from Hardleys, Ltd. (Mr. C. 0. Butler), for damage sustained by Ins Buick car through collision with a motor truck, driven by one of defendant's employees. The collision took place on May 7. at the corner of Park Road and Park Avenue. Plaintiff's car was being driven by his wife. Defendants counter-claimed for £4 10s for damage sustained by their truck. Each side alleged negligent driving on the part of the other. At the time of the accident plaintiff's car was on the point of turning from Park Avenue info Park Road and defendant's lorry, which was proceeding in the opposite direction, was turning from Park Road into Park Avenue. For the plaintiff it was contended the collision resulted from the lorry driver not turning the corner properly, travelling at from 15 to 20 miles an hour. The rear portion of the lorry collided with the front right hand portion of the car. through the lorry being .pulled into the right, before it. was clear. The speed of the car, when approaching the corner, was slated to be from six to eight miles an hour.
For the defence it was contender] (ho responsibility for Ihe accident was on the driver of plaintiff's car, which, it was alleged, ran into the lorry. Evidence was given (lint llie lorry was driven at a reasonable speed. After hearing lengthy evidence on both side-, the magistrate rcHcrved his decision.
