AGED COUPLE'S APPLICATION.
COMMENT BY MAGISTRATE. Another application, in which a couple aged 80 and 78 respectively, sought possession of a house they had purchased, came before Mr. W. R. McKean, S.M. Living with defendant was her brother, a discharged soldier, with three years' service, who had been both wounded and gassed.' Mr. Sullivan, for defendant, contended that this fact, under the Act, barred any order being made for possession. Mr. Dickson, for plaintiffs, said his client would be content with two rooms in the house. He emphasised the hardships of two aged people being kept out of premises they had purchased for a home. The magistrate said people who purchased houses occupied by tenants took a risk. There were empty houses in" Auckland for sale. The buildings would not be let as the owners knew the difficulty there was in giving possession to purchasers. Decision was reserved.
