POSSESSION OF HOUSES.
AN APPLICATION . GRANTED.
CLAIM AND COUNTER-CLAIM.
• A claim for possession. of a tenement in Risk Road, Remuera, occupied by Robert Poole (Mr. Hosking), harbour board employee, and £15 15s rent alleged to be due., was made by David Thfeyera (Sir. A. E. Skelton), commercial traveller, in the Magistrate's Court before Mr. J. W. Poynton, S.M. Plaintiff claimed that he wanted the premises for his own use; i that defendant had committed . waste and [ was failing to take reasonable care of the premises; and that defendant had failed to pay the rent, £1 2s €d a week, for 14 weeks. Defendant counter-claimed for £6 15s, of which £1 15s to be due for storage of plaintiff's furniture Defendant further alleged that on October 12 plaintiff wrongfully entered the premises, locked up two rooms, and took the key away. For this defendant claimed £5 damages. After hearing considerable evidence the magistrate made an order for possession of the premises on or before December 7. Judgment was for plaintiff for the rent claimed. £15 15s, and for defendant on the counter-claim for £1 15s Costs were allowed plaintiff.
