«3. . CLAIM .FOR COST OF REPAIRS. An action involving a claim for £58 2s, cost of repairs to a motor and general damages as a result of an accident on the road near Drury was heard at the Magistrate's Court yesterday before Mr. .!. \V. Poynton, S.M. I The plaintiff was J. C. Young (Mr. Meredith), laundry manager, of Auckland, and the defendant W. H. Maxwell (Mr. Ostler), farmer, of Runriman. The facts as outlined by counsel were that the plaintiff was driving a motor-car on the road near Drury and met defendant, who was drivinc; a horse and cart. Projecting from the back of the cart was a pole. As the car approached the cart, the horse swerved and the motorist, in order to prevent the occupants of the car being struck by the projecting pole, was compelled to run on to a heap ol stones, as a. result of which the vehicle was seriously damaged. A number of witnesses gave evidence on both side? as to the nature of the happening. 'Ihe magistrate said lie would prefer to see the scene of the accident, before giving judgment, and adjourned the case until after he had visited the locality.
