PROBATE AND NATIONALITY.

-'TITLES OF COMPANIES.

Amended rules under the Judicature Act, 1908, touching the procedure and practice of Courts, and having reference to accountants, probate and letters of administration, taxation of costs, holidays, and rules' relating to procedure under the Companies Act, 1908, have been issued, and take effect as from Julv 13.

In respect of accountants, the amended rules provide that where there is a reference of accounts to an accountant, or the registrar and an accountant, then, unless otherwise ordered, the accountant shall be selected from the members of the New Zealajid Society of —"Accountants, classified as Public Accountants.

In regard to applications for probate, or J letters of administration, or for the re- I sealing in New Zealand of probate, or ! letters of administration, granted elsewhere, it is now laid down that an affidavit shall be filed stating explicitly the place of birth and the nationality of the deceased and of the applicant. In case the deceased shall have been a subject of any foreign State or Sovereign, but it is now claimed that he had since become a British subject, the affidavit shall state when and how he became a British subject. A similar rule, it is laid down, shall apply to any applicant who shall j have been at any time a subject of a foreign State or Sovereign, but. now claims I to have become a British subject. In case j deceased or any applicant be or shall have been a subject of any State or Sovereign, for the time being at war with His Majesty the King, the applicant shall state whether, and by what means or instrument, he has obtained the consent of the Attorney-General to the application. These lilies relating to probate and letters of administration, it is stated, are made to ensure, ccmpliajice with regulations made by the Govenior-in-Council on February 22. and published in the New Zenland Gazette of February 25. They will not lapse bv reason of the present, war coming to. an end. but will remain in force until repealed or rescinded bv means of a. general rule made pursuant to the Judicature Act, 1908. The rules relating to taxation of costs state that whether as between party and partv. or solicitor and client, no charge shall be allowed for the preparation or service, of the bill of costs or of any copv thereof. The rules relating to procedure under the Companies Act. 1908. are to th« effect, that written notice of every application to the Court, for an order chancing the name of aiir company shall be sent, to the Registrar of Companies.
