DIVORCE CASES HEARD. THE MARRIAGE : CERTIFICATE. The civil sessions of tho Auckland Supremo Court were continued before His Honor Mr. Justice Cooper yesterday. Two divorce cases were considered. Arthur Lyttelton Cubitt, carter, of Auckland (Mr. Beale), applied-- for a dissolution of his marriage with Evelyn Ellen i Cubitt, and cited Harold Callot as corespondent. The petitioner stated that ho! i married respondent in March, ■ 1907, and! had had differences with her on account of her drinking habits. Ultimately he left respondent, allowing her to keep tho home! and giving her 10s weekly. At her re-1 quest he returned, but after four or six months lie was compelled to leave her again. Through a misunderstanding a' maintenance order was issued against him on that occasion, and again ho returned to his wife, but onco more ho found it impossible to stay with her. At this stage His Honor asked that the marriage certificate should bo, produced, but Mr. Beale said ho did not have it with him. It further transpired that tho wrong name had been given in the certificate, and that tho woman was not a spinster, as sot forth, but a divorcee. Continuing his evidence, petitioner said he had made tho weekly payments of 10s until he found that his wife was living with the co-respondent. j The marriage certificate was produced later, and it was found that tho inconsistencies complained of were contained therein. In addition, the petitioner's age was given as 41 years, while he stated in Court, that ho was only 31 years of age at the present time. The jury fonnd that respondent had! committed adultery, but the case was ad- 1 journed for a week, in order that the Court might bo satisfied as to tho marriage of petitioner and . respondent. Further, His. Honor desired evidence as to I respondent's means. , DECREE NISI GRANTED. Tiie other case was that in which Louisa Caroline Griffiths (Mr. Allan Moody), sued for a divorce from Llewellyn Evan Argyle Griffiths. Tho petitioner said she married Griffiths in Christchurch in 1891. In 1905 tho respondent became very familiar With another, woman, in spite of petitioner's repeated objections. Ultimately sho left her | husband and came to Auckland, while 1 Griffiths continued to live with the other 1 woman under the name of Argyle. A decreo nisi, to bo mado absolute in; three months, was granted, costs on the. lowest scale being allowed. I
