TRAINER SECURES DAMAGES.

TASKER V. METROPOLITAN

TROTTING CLUB.

[B7 TELEGRAPH.— ASSOCIATION.]

Chsistchtjboh, Sunday. Judgment in tho case of Clifford Tasker versus the New Zealand Metropolitan Trotting Club has been delivered by Mr. Justice Denniston. The case was heard some time ago and delivery of judgment was recently postponed. Alter reviewing the circumstances of the case, II ii Honor dealt with special issues which were put to the jury.

"The jury'" he said, " had all tho facts before it. and no objection has been taken to my directions, or to the lorn* of the issues. I think the fact of tho finding is that, while the sate was shut and padlocked, the structure and condition of the fastenings were not mch as to make it a secure or sufficient obstacle <o the escape of tho mare, In ray opinion it lay on the defendants— the maro in fact having escaped from tho paddock— show thai they had made such escapc reasonably impossible, unless by active interference of trespassers.

i " I think that the jury was justified in i finding negligence The real issuo is, ; however, obviously the duty owed by the , owner of the land, the use of which tie hiroa • to another for specific purposes, to use all I reasonable cure so that the land is not until j for such purposes. A heavy draught maro | galloping down upon one is not an incident, I which a trainer lawfully usintj a training j track was entitled to expect, Ihoso observaI tions apply also to tho finding of die jury on : the 6ixth issue- Defendant had a caretaker I in charge of the track, and ho was on the I track at 5 a.m. The jury was, in my opinj ion, entitled to find that it was duty oi the caretaker, as tar as possible, to see that a stray horse was not allowed to be on, or to remain on, the track during lie tine it was being lawfully oc;upiod by trainers. Tho motion for nonsuit or judgment (or defendant is dismissed. Plaintiff will .Save judgI went for £200, with costs."
