PECULIAR ACTION FOR DAMAGES

OisBORXE. Thursday. A .strange pet. in the shape of a Ceylon mongoose was the subject of a civil action at the .Magistrate's Court this afternoon, when Cower Bradley Smith proceeded against Berber' Yard ley for the recovery of £2, damages in respect to a mongoose,' the property of plaintiff, which was shot by defendant on May 3. Plaintiff stated that he had owned the mongoose for some time, and it was perfectly harmless.

Defendant admitted shooting the animal, and said he found the mongoose in his fowlhouse, and thought it was a weasel.

After counsel had addressed the Court, His Worship said he thought this was a case in which defendant should succeed. If persons desired to keep strange animals, they should keep them on their own premises, and not allow, them to stray on other people's property. Personally he was sure that had such a strange animal come into his yard, la- would hive disposed of it as the defendant had done.

Judgment was given for defendant, with £1 19s costs
